벌점·행정처분 후 곧바로 '행정소송'…효력 정지 기간 동안 '수주 활동' 가능'등록말소' 등 강력한 처분 실제 사례 나와야

B업체는 2019년 9월 벌점을 받고도 29건, 약 640억원의 공사를 수주했다.LH는 입찰 시 벌점을 받은 업체에는 감점하는 등 불이익을 주는데, 이런 일이 가능한 이유는 행정소송을 통해 벌점 효력을 정지할 수 있기 때문이다. 벌점을 부과받은 업체들은 처분 효력 집행정지 소송을 내고, 법원에서 인용이 되면 처분 취소 행정소송을 걸어 본안 소송 결과가 나올 때까지 벌점 처분 효력이 정지된다. 이렇게 되면 법적으로 '벌점 없는' 업체가 되는 셈이다. 최종 법적 판단은 적어도 4~5년이 걸리므로 이 기간에는 수주 활동에 제약받지 않는다.허 의원은 "벌점 받은 업체들이 벌점 부과 취소 소송을 제기한 33건 중 현재 진행 중인 4건을 제외하고 29건 모두 (업체들이) 패소했다"며 "소송 제도를 악용해 사익을 추구한 것이 명확히 드러난 것"이라고 말했다.
